These Terms of Use govern your access to and use of the website operated by Leonard Kalishenko and Associates (“LKA”, “we”, “us”, or “our”) at kalishenko.com (the “Site”).
By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
About the Site
The Site is a marketing and portfolio website for our engineering consulting and structural design practice. Content on the Site is provided for general information only. It does not create an engineer–client relationship, and it is not a substitute for professional engineering advice for a specific project.
Acceptable use
You agree not to:
- Use the Site in any way that violates applicable law
- Attempt to gain unauthorized access to the Site, related systems, or data
- Interfere with or disrupt the Site or the servers or networks connected to it
- Submit false, misleading, or abusive content through the contact form
- Scrape, harvest, or systematically extract content from the Site without our prior written consent, except as allowed by ordinary search engine indexing
Intellectual property
Unless otherwise noted, the Site and its content — including text, images, graphics, logos, and layout — are owned by LKA or our licensors and are protected by Canadian and international intellectual property laws. You may view and print pages for personal, non-commercial use. Any other use requires our prior written permission. See our Copyright page for infringement notices.
Project and portfolio information
Project descriptions, images, and related materials on the Site may be illustrative, summarized, or updated over time. They are not warranties of future performance or outcomes for other projects. Where client names or logos appear, they do so with permission where required; their appearance does not imply endorsement of LKA beyond the relationship described.
Third-party links
The Site may link to third-party websites. We are not responsible for the content, privacy practices, or availability of those sites. Accessing third-party sites is at your own risk.
Disclaimer of warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, LKA and its principals, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site. Our total liability for any claim arising out of or relating to the Site will not exceed one hundred Canadian dollars (CAD $100).
Nothing in these Terms limits liability that cannot be limited under applicable law.
Professional services
Engagement for engineering or consulting services is governed by a separate written agreement between you and LKA. These Terms do not amend or replace any such agreement.
Privacy
How we collect and use personal information is described in our Privacy Policy.
Changes
We may update these Terms from time to time. The “Effective date” on this page reflects the latest revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Courts located in Toronto, Ontario will have exclusive jurisdiction over disputes arising from these Terms or the Site, subject to any mandatory consumer protections that apply to you.
